By accessing and using AFFECTIVELY ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

AFFECTIVELY is an emotion tracking and analysis platform that allows users to log emotional states, receive AI-powered insights, and track patterns over time. The Service is provided "as is" and we reserve the right to modify or discontinue the Service at any time.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and identification
  • Accept all responsibility for activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

The Service offers both free and premium subscription tiers:

  • Free Tier: Limited to 50 reflections with basic features
  • Premium Tier: Unlimited reflections with full AI features and advanced analytics

Premium subscriptions are billed on a recurring basis. You may cancel your subscription at any time. Refunds are handled according to our refund policy, available upon request.

5. User Content

You retain ownership of all content you submit to the Service. By submitting content, you grant us a license to use, store, and process that content solely for the purpose of providing and improving the Service. You are solely responsible for the content you submit and represent that you have all necessary rights to do so.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any laws in your jurisdiction
  • Infringe upon the rights of others
  • Transmit any malicious code or viruses
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission

The Service does not provide medical advice, diagnosis, or treatment.   • AI-generated insights are probabilistic and should not be treated as definitive facts

  • AI-generated content is not a substitute for professional judgment or expertise
  • You should verify important information and consult qualified professionals for critical decisions

You are solely responsible for evaluating and using AI-generated content at your own discretion and risk.

11. Data Accuracy and Limitations

You should interpret all insights, patterns, and recommendations with appropriate caution and skepticism, and should not rely solely on the Service for important life decisions.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AFFECTIVELY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the Service
  • Damages resulting from reliance on AI-generated content or insights
  • Damages resulting from decisions made based on Service recommendations
  • Damages resulting from mental health or medical decisions made without professional consultation
  • Any other damages arising out of or in connection with the Service

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless AFFECTIVELY and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.

16. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new terms. If you do not agree to the modified terms, you must stop using the Service.
